Acceptable Use Policy (the "AUP")
ProuFX (the “Company”)


1. Scope of this AUP
1.1. This AUP applies to your, the User, use of the website www.proufx.com (the “Website”) unless explicitly indicated otherwise by the Company in the specific Terms of use applicable to the use of the Website.
1.2. You (the "User") undertake to read and fully understand this AUP prior to making any use of the Website. The AUP may be changed from time to time, in accordance with the Company’s sole discretion.
1.3. The prohibited activities and uses set out in this AUP are not a complete list.

2. Prohibited Activities
2.1. The User will not use the Website:
2.1.1. Fraudulently or in connection with any criminal offense.
2.1.2. To send, knowingly receive, upload, download, or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy and/or any other rights.
2.1.3. To cause annoyance, inconvenience or anxiety.
2.1.4. To spam or to send or provide unsolicited advertising or promotional material or to knowingly receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party.
2.1.5. In any way which, in Company’s reasonable opinion, is or is likely to be detrimental to:
(i) the provision of the Trading services by the Company to the users;
or
(ii) to the Company’s business, good name and reputation.
2.1.6. In contravention of any licenses or third-party rights.
2.1.7. To attempt to interfere with any of Company’s service to any user, host or network which includes, flooding of networks, deliberate attempts to overload Company’s service.
2.1.8. For transmitting E-mails or files which contain computer viruses or corrupted data or Trojan horses or tools which compromise the security of the Website.
2.2. User will not copy, distribute, publish, transmit, display, modify or prepare derivative works based on, report or otherwise use the Website in whole or in part for the use of any other person. In particular, User will not demonstrate or allow access to or use of the Website to a third party without Company’s written consent.
2.3. The trademarks and logos displayed on the system are registered trademarks of the Company and any use of such trademarks may only be allowed after the written consent of the Company has been obtained.
2.4. User acknowledges and agrees that the list of prohibited activities set out above is a non-exhaustive list.

3. Network Security
3.1. User shall not:
3.1.1. Violate or attempt to violate Company security or attempt to interfere or interfere with Company’s networks, authentication measures, servers or equipment.
3.1.2. Attempt to circumvent user authentication or security of any host, network or account which includes accessing data not intended for User, logging onto a server where access is not authorized or probing the security of other networks.
Attempt to gain access to any account or computer resource not belonging to User through Company’s Website or services.

4. Identification for the use of the Website
4.1. User shall ensure that measures be taken to warrant that the respective usernames and passwords or other identification measures used for the same purposes (the "Logins") are being used exclusively by User. Furthermore, User shall ensure to keep their respective Logins secret and to not disclose them to any third-party. To avoid any accidental disclosure, the Login shall not be recorded in any form by which it could be used by any other person. If User is aware of any non-eligible person having access to or knowledge of any Login, User shall inform Company of such fact without delay.
4.2. Company may stop any person from accessing the services on the Website and may take such adequate measures as Company deems necessary to prevent such access, if Company becomes aware of any circumstances which give reason to believe that a Login is being misused. In addition thereto, Company shall be entitled to prevent Client access to the services on the Website for good cause at its discretion.
4.3. User agrees that every person using an Login (whether or not in fact such person is a duly authorised client) will be deemed to be authorised to enter into the account and service on the Website and/or (as the case may be) to give any other instructions or communications on behalf of User that is represented by the Login according to the registration information provided by User wherever such person has identified himself to Company by a Login. Company will act on such instructions without being obliged to obtain any further written or other confirmation, and, for the avoidance of doubt, the relevant transaction fees will become payable and the result of the transactions will be applicable to User’s account.

5. Violation of this AUP
5.1. If the User violates any term of this AUP, the Company may, without notice to User and without any liability to User or any other party:
5.1.1. Suspend or terminate User use of the Company’s Website or service; or
5.1.2. Take any action as it considers appropriate.
For the avoidance of doubt, the exercise by the Company of its rights hereunder will not require the Company to compensate the User for loss of access to the Company’s Website, User’s account and services.
5.2. A violation of this AUP by a person having only indirect access to the Company services through the User’s account will be considered a violation by the User, including whether or not the violation was in with the knowledge or consent of such User. The User is responsible for any and all actions of executed through the use of the User’s login information.
5.3. The Company may cooperate with system administrators or other network or computing services providers to enforce this AUP or a policy of another provider
5.4. The Company may involve and will cooperate with law enforcement if criminal activity is suspected.

6. Amendments to this AUP
This AUP is subject to change at Company’s sole discretion at any time and any change is effective when posted on Company's Website or otherwise made known to the User.
